WASHINGTON, Oct. 23 -- Sen. Jon Tester, D-Mont., has introduced legislation (S. 4836) to "prevent efforts of the Department of Justice to advocate courts that an individual exercising the authority of the head of an agency for more than a year, regardless of their title, is not in violation of the Federal Vacancies Reform Act of 1998."
